Annual Tax on Enveloped Dwellings, commonly known as ATED, is an annual tax charge that applies to certain non-natural persons, including companies, some partnerships and collective investment schemes that hold UK residential property valued at more than £500,000.
Even where no tax is ultimately payable, an ATED return or relief declaration is often still required to maintain compliance.
Stratos helps companies and other entities, advisers and shareholders understand whether ATED applies to them, identify available reliefs or exemptions, calculate any liability and file the required returns on time.
The amount of ATED payable depends on the value of the property, and the reporting position can change where properties are acquired, developed, converted, revalued or the use changes.
When ATED advice may be needed
- A company owns one or more UK residential properties worth more than £500,000.
- A residential property has recently been acquired through a company.
- A property is used in a property development or trading business.
- You have missed a filing deadline or received an HMRC penalty notice.
- You are unsure whether ATED applies to you.
- You are unsure whether a relief or exemption applies.
- The property has been revalued or there has been a change in use.
ATED reliefs and exemptions
A number of reliefs may reduce or eliminate the ATED charge, depending on how the property is used. These can include reliefs for qualifying property rental businesses, property developers, property traders and certain employee accommodation.
ATED filing deadlines
Annual returns are generally due by 30 April for the chargeable period beginning on 1 April in the same year to 31 March in the following year. New acquisitions and newly built or converted properties can have different filing windows and it is important to seek advice on the windows for these if you are acquiring a new property or converting an existing property.
Late filing or late payment can lead to penalties and interest, even where relief would have been available if claimed correctly.

Restoring ATED Compliance While Claiming Available Exemptions
The Challenge
A client reached out to Stratos after receiving a notification from HMRC regarding their failure to file an Annual Tax on Enveloped Dwellings (ATED) return. Despite being eligible for relief under employee occupation, they had not submitted an exemption claim for the years ended 31/03/2016 to 31/03/2022.
HMRC informed the client that they owed significant penalties due to the late filing, and the client was required to pay £9,100 in penalties for failing to submit their ATED return on time. The client was unaware of the need to file the exemption claim by the 30th April each year to avoid such penalties. As per HMRC regulations, any late return by more than 3 months incurs a £10 daily penalty for up to 90 days.
The Solution
Stratos took immediate action to address the situation and provide the following solutions:
- We swiftly submitted the correct exemption claim for the relevant years, ensuring the client met the eligibility criteria for relief under employee occupation. This action helped to resolve the outstanding ATED obligations and ensured no further penalties were levied by HMRC.
- We educated the client about ATED filing deadlines and exemption claims to ensure that future returns are submitted on time and no penalties are incurred. Our team provided annual reminders to ensure compliance moving forward.
The Value
- The client’s exemption claims were properly filed, bringing them into compliance with HMRC’s ATED regulations, ensuring no further penalties.
- The client now fully understands their ATED filing obligations, and with our ongoing support, they can rest assured that future returns will be submitted accurately and on time, avoiding penalties in the future.
